BY USING ARTH, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE. These terms govern your use of the Arth product available at askarth.com. Your use of Arth is also governed by our Privacy Policy, which explains how we collect, process, store, and protect your information.
1. Description of Service
Arth (the "Service") is an AI-powered tool that helps you prepare your income tax return. The Service:
- (a) Parses tax documents you upload (Form 16, AIS, broker statements, RSU confirmations, and other tax-related files);
- (b) Populates ITR sections from extracted data — salary, deductions, capital gains, Schedule FA, taxes paid;
- (c) Computes tax liability under old and new regimes;
- (d) Generates ITR JSON for upload to the income tax department portal; and
- (e) Provides an AI assistant that answers questions about your specific filing.
2. Not Professional Advice
2.1 Arth is not a chartered accountant, tax consultant, or registered financial advisor. The Service does not provide professional tax advice or financial advice.
2.2 The computations, suggestions, and ITR output provided by Arth are for informational purposes only.
2.3 Arth does not file your return for you. The Service prepares the data and generates ITR JSON. You upload the JSON to the income tax portal and e-verify it yourself. The filing is your act, not ours.
3. AI-Generated Content
3.1 Arth uses artificial intelligence to assist with document parsing, tax computations, and answering tax-related questions. AI-generated outputs may occasionally contain errors, omissions, or incorrect interpretations. Users should independently verify all information before relying on it.
3.2 AI-generated explanations should not be treated as authoritative tax guidance. When in doubt, refer to the Income Tax Department website or consult a qualified chartered accountant.
4. Government Non-Affiliation
Arth is an independent software platform and is not affiliated with, endorsed by, or operated by the Income Tax Department of India, the Central Board of Direct Taxes (CBDT), or any other government authority.
5. Your Account
5.1 You sign in using your Google account. You are responsible for maintaining the security of your Google credentials.
5.2 One account per person. You may not create multiple accounts or share your account credentials with others.
5.3 You must be at least 18 years of age to use the Service.
5.4 We may suspend or terminate accounts immediately in cases involving fraud, abuse, security risks, or legal requirements.
6. Your Data and Privacy
6.1 You own your data. The tax documents you upload, the information you enter, and the filings you create belong to you. We do not claim any ownership over your content.
6.2 You grant us a limited, non-exclusive licence to process your data solely for the purpose of providing the Service — parsing documents, computing tax, generating ITR JSON, and powering the AI assistant. We do not use your data for any other purpose.
6.3 We will process account deletion requests within 30 days, except where retention is required by law.

7. Your Responsibilities
You are solely responsible for:
- (a) Providing accurate and complete information;
- (b) Reviewing the information generated by Arth and correcting any inaccuracies;
- (c) Attaching supporting documents where required by the income tax department;
- (d) Submitting the final return through the Income Tax Department portal; and
- (e) Filing your return on time and retaining your original tax documents.
8. Acceptable Use
You agree not to use the Service to:
- (a) Prepare fraudulent tax returns or misrepresent your income;
- (b) Upload documents that do not belong to you without the owner's authorisation;
- (c) Attempt to access other users' data or interfere with the operation of the Service;
- (d) Reverse-engineer, decompile, scrape, or copy any part of the Service; or
- (e) Use the AI assistant for purposes unrelated to tax filing.
9. Foreign Assets and Complex Cases
Certain tax situations — including but not limited to foreign assets, foreign income, capital gains from international securities, trusts, business income, and international tax matters — may require additional professional review. Arth does not guarantee that every complex tax scenario is fully identified or accurately handled. See our Disclaimer for guidance on when professional advice is appropriate.
10. Tax Law Changes
Tax laws, ITR forms, slab rates, and filing requirements may change after computations are generated. You are responsible for ensuring that your return complies with the applicable law at the time of filing. Arth updates its computation engine to reflect published changes, but there may be a delay between a regulatory change and its implementation in the Service.
11. Fees and Payment
11.1 Arth offers both free and paid features. Free features may be limited in scope or usage volume.
11.2 Payments are processed by Razorpay. When you make a payment, Razorpay handles your card or UPI details directly. We never see or store your payment credentials. Razorpay's own terms and privacy policy apply to payment processing.
11.3 Paid plans are non-refundable unless the Service was materially unavailable during your subscription period. If you believe you are entitled to a refund, email contact@askarth.com.
12. Third-Party Services
Arth relies on third-party services to function. These include:
- (a) Authentication providers (Google Sign-In);
- (b) AI model providers for document parsing and the assistant;
- (c) Cloud infrastructure providers (Microsoft Azure);
- (d) Payment processors (Razorpay); and
- (e) Analytics providers (Google Analytics).
We are not responsible for outages, errors, or failures caused by these third-party services. Each third-party service is governed by its own terms and privacy policy.
13. Limitation of Liability
13.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
13.2 WE SHALL NOT BE LIABLE FOR ANY PENALTIES, INTEREST, LOSSES, OR OTHER CONSEQUENCES ARISING FROM ERRORS IN YOUR TAX RETURN, WHETHER CAUSED BY THE SERVICE OR OTHERWISE.
13.3 TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO ARTH DURING THE PRECEDING TWELVE (12) MONTHS.
14. Indemnification
You agree to indemnify and hold Arth harmless from any claims, damages, losses, or expenses (including legal fees) arising out of your misuse of the Service, violation of these Terms, or submission of false, misleading, or unlawful information.
15. Force Majeure
We are not responsible for failures or delays in providing the Service caused by events beyond our reasonable control, including but not limited to internet outages, cloud provider failures, government actions, regulatory changes, cyberattacks, or natural disasters.
16. Intellectual Property
16.1 The Arth name, logo, software, website content, and documentation are our property (or that of our licensors). You may not copy, modify, or redistribute them without written permission.
16.2 Your data remains yours. The ITR JSON we generate from your data is yours to use however you wish.
16.3 Feedback, suggestions, or feature requests submitted by users may be used by Arth to improve the Service without obligation to compensate the user.
17. Beta Features
Certain features may be marked as beta or experimental. These features are provided for evaluation purposes, may contain bugs, and may be modified or discontinued without notice. We make no guarantees regarding the accuracy or availability of beta features.
18. Service Availability
18.1 We aim to keep the Service available at all times, but we do not guarantee uninterrupted or error-free access. We may suspend the Service for maintenance, updates, or operational reasons.
18.2 We may modify, update, or discontinue features of the Service at any time. If we discontinue the Service entirely, we will provide reasonable notice and the ability to export your data.
19. Termination
19.1 You may stop using the Service at any time. To delete your account and all associated data, email contact@askarth.com. We will process deletion within 30 days, except where retention is required by law.
19.2 We may suspend or terminate your account immediately in cases involving fraud, abuse, security risks, or legal requirements.
20. Governing Law and Jurisdiction
20.1 These Terms shall be governed by and construed in accordance with the laws of India.
20.2 Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.
21. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the website. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
22. Survival
Sections relating to ownership (Section 6), liability (Section 13), indemnification (Section 14), intellectual property (Section 16), dispute resolution (Section 20), and any obligations that by their nature should survive termination, will continue in effect after termination of your use of the Service.
